CharacterSphere.ai Terms of Service

CharacterSphere.ai is operated by TachyonX Ltd, a Private Limited Company registered in England & Wales No. 06757594, governed by UK law. If you disagree with any part of this Agreement, please do not access or use the Service.

CharacterSphere.ai is a community driven platform for high quality immersive roleplaying, story-telling, creative writing and expression and world-building experiences.

Key Definitions

  • "Service / Platform" – the CharacterSphere.ai website & app that enables AI-character conversations in a community setting.
  • "Content" – any material generated, displayed or accessed: text, images, videos, voice, character cards, lore-books, chat transcripts, etc.
  • "AI Characters" – artificial-intelligence personalities you create or interact with.
  • "User / you / your" – any natural person who accesses the Service.
  • "CharacterSphere.ai moderation team" – sole deciders of ToS violations.

Your Account & Eligibility

  • You must be a natural person ≥ 18 years old.
  • Provide accurate registration data & keep credentials secure.
  • You are fully responsible for all activity under your account.
  • You may terminate your account at any time. If you have Aurum or Premium on your account, no refunds will be issued.
  • Termination of your account will remove all your AI generated content from the platform (your AI characters, your conversations)

Your Use of the Service

  • CharacterSphere.ai is a community platform where users create, share & converse with AI characters.
  • Core functionality is free; premium features may require a paid subscription or premium currency.
  • You bear full material & legal responsibility for all Content you generate, own and share.

Content Ownership & Licence

  • You own your AI outputs (character descriptions, images, videos, chat transcripts) to the fullest extent permitted by law and you may exploit them commercially or non-commercially at your sole risk.
  • You grant TachyonX Ltd a non-exclusive, worldwide, royalty-free, fully-paid-up, transferable, sub-licensable, perpetual, irrevocable licence to host, display, distribute, advertise, promote and otherwise use your AI-generated Content for the purpose of operating, promoting & improving the Platform.
  • Private Content Protection: Private characters and private conversations are never used for promotional or advertising purposes. This includes character descriptions, chat transcripts, and any user-generated content marked as private.

Acceptable-Use Restrictions

You may NOT use the Service to generate, upload, store or share Content that:

  • Promotes terrorism, gathers terrorist information or facilitates terrorist acts (Schedule 5, UK OSA 2023).
  • Involves minors in any NSFW context (visual, textual or behavioural) (Schedule 6, UK OSA 2023).
  • Depicts or encourages self-harm or suicide (Schedule 7, UK OSA 2023).
  • Is hate speech, harassment, abuse, or discrimination.
  • Impersonates real third parties or creates deep-fakes of real people (image, voice or video).
  • Spreads political misinformation or facilitates financial pyramid schemes.
  • Infringes IP or privacy rights.
  • Breaks any other criminal or civil law.

Intentional circumvention of technical safeguards (prompt injection, etc.) is a breach of these Terms.

Platform Risk Management & Monitoring

You acknowledge and agree that all content on the platform is actively monitored for compliance with legal requirements and platform safety standards. CharacterSphere.ai implements the following proactive measures in accordance with the UK Online Safety Act 2023:

  • Proactive Risk Assessments: Systematic risk assessment and monitoring is performed to prevent the generation of strictly illegal content, including but not limited to hate speech, harassment, fraud, and other criminal material (Schedule 5-7, UK OSA 2023).

Determination of Breach

The CharacterSphere.ai moderation team decides at its sole discretion whether these Terms have been violated. Consequences may include:

  • Warning.
  • Time-limited or indefinite suspension of your account.
  • Deletion of related chats/characters.

Our actions are not exhaustive and monitoring activities do not create a duty to monitor all content.

Freedom of Expression

You may exercise your right to Freedom of Expression (Art. 10 ECHR / Human Rights Act 1998) by republishing their own Content off-platform; they assume all liability for such republication and must indemnify TachyonX Ltd against any claims arising therefrom.

Data Portability

You may download your character descriptions & chat transcripts (UK GDPR Art. 20).

Reporting

Use the in-platform "Report" function or e-mail contact@charactersphere.ai to flag Content or characters that violate these Terms.

AI Content Disclaimer

AI output is entertainment only, provided "as-is" without warranties. It is not professional advice (medical, legal, financial, etc.). You rely on it solely at your own risk.

Privacy

Handled in accordance with our Privacy Policy; conversation memory is core to the Service.

Liability & Indemnity

To the fullest extent permitted by law TachyonX Ltd is not liable for any indirect, incidental, consequential or punitive damages.
You indemnify TachyonX Ltd, its officers, employees and affiliates against all claims arising from your use of the Service, your Content, or your breach of this Agreement.

Copyright (DMCA)

Notices to contact@charactersphere.ai must contain all elements required by 17 U.S.C. §512(c)(3). Your notice must include:

  • Your physical or electronic signature.
  • Identification of the copyrighted work claimed to be infringed.
  • Identification of the material to be removed and its location.
  • Your contact information.
  • A statement that you have a good faith belief the use is not authorized.
  • A statement that the information in your notice is accurate.

Changes to the Services and this Agreement

We reserve the right to modify services or these terms. For premium accounts, we will provide reasonable notice before terminating services, except in cases of serious breach of these terms (e.g., illegal activity, hacking, harassment). In case of a "serious breach," termination may be immediate and without notice.
